Dörken Coatings GmbH & Co. KG  (hereinafter ”DÖRKEN Coatings“) is delighted that you have visited these websites. We only process personal data on these websites to the technical extent necessary.  Below we inform you about the type, handling and purposes of the collection, processing and use of your personal data in connection with the use of our websites. This data protection declaration applies to the entire Dörken Coatings  website, but not to pages of other providers for which you will find links on our pages. Our security procedures are regularly reviewed and adapted to technological progress.

3. Your rights
You have the following rights vis-à-vis us regarding your personal data:

3.1 General rights:
You have a right of access, rectification, cancellation, restriction of processing, objection to processing and data transferability. If processing is based on your consent, you have the right to revoke this consent with effect for the future.

3.2 Rights in data processing according to legitimate interest
According to art. 21, sub-section 1, GDPR, you have the right to object at any time to the processing of personal data concerning you on the basis of art. 6, sub-section 1, lit. e) GDPR (Data Processing in the Public Interest) or art. 6, sub- section 1, lit. f) GDPR (Data Processing Safeguarding a Legitimate Interest) for reasons arising from your particular situation; this also applies to profiling based on this provision. In the event of your objection, we will no longer process your personal data, unless we can prove compelling reasons worthy of protection for the processing, which outweigh your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.

3.3 Rights in the case of direct marketing
If the personal data concerning you is processed for direct marketing purposes, you have the right under
art. 21, sub-section 2, GDPR to object at any time to the processing of the personal data concerning you for the purpose of such advertising; this also applies to profiling, insofar as it is associated with such direct marketing.
If you object to the processing for direct marketing purposes, the personal data concerning you will no longer be processed for these purposes.

3.4 Right of appeal to a supervisory authority
You also have the right to complain to a data protection supervisory authority about the processing of your personal data.

 

4. Collection of personal data when you visit our website
When using the website for information purposes only, i.e. if you do not register or otherwise provide us with information, we only collect the personal data that your browser transmits to our server. If you wish to view our website, we collect the following data, which is technically necessary for us to display our website to you and to guarantee stability and security.  The legal basis for this is
art. 6, sub-section 1, lit. f) GDPR; the legitimate interest is the maintenance and safe provision of our services:
IP address, date and time of the request, time zone difference to Greenwich Mean Time (GMT), content of the request (specific page), access status/HTTP status code, amount of data transmitted in each case, website from which the request comes, browser, operating system, and its interface, language and version of the browser software.

 

5. Contact by e-mail or contact form
When you contact us by e-mail or via a contact form, the data you provide (your e-mail address, your name and, if applicable, other information) will be stored by us in order to answer your questions or to answer your inquiry. If we use our contact form to request information that is not required to establish contact, we have always marked it as optional. These details serve us to specify your inquiry and to improve the processing of your request. This information is provided expressly on a voluntary basis and with your consent,
art. 6, sub-section 1, lit. f) GDPR. If this involves information on communication channels (e.g. e-mail address, telephone number), you also agree that we may contact you via this communication channel in order to respond to your request. You can of course revoke this consent at any time in the future.
We delete the data arising in this context once the storage is no longer necessary, or limit the processing if statutory retention obligations exist.


5.1 Communication by Facebook Messenger
This offer uses the Facebook Messenger of Facebook Inc, 1601 S. California Ave, Palo Alto, CA 94304, USA ("Facebook") as an additional communication medium. The data and contents of the communication are processed via servers in the USA. Facebook also evaluates the metadata of the communication for advertising purposes, but not the content of the messages.

7. Use of Cookies
When you use our website, cookies are stored on your computer. Cookies are small text files that are stored on your hard disk in the browser you use and through which certain information flows to the place that sets the cookie. 7.1 Transient Cookies
These cookies are automatically deleted when you close your web browser.   These include in particular the session cookies. These save a so-called session ID, which allow the various requests from your web browser to be assigned to a single session.   This makes it possible to recognise your device when you return to the website.  Session cookies are deleted as soon as you log off or close your browser.

7.2 Persistent Cookies
These cookies are deleted automatically after a determined amount of time that can be different for different cookies. You can delete these cookies from the safety settings of your web browser at any time.

7.3 Preventing Cookies

7.4 Legal bases and storage period
The legal basis for possible processing of personal data is
art. 6, sub-section 1, lit. f) GDPR in order to make our website more user-friendly and to enable an analysis of users' surfing behaviour. Cookies are stored on the user's computer and transmitted to our site. Therefore, you as a user also have full control over the use of cookies. You can deactivate or restrict the transmission of cookies by changing the settings in your Internet browser. Cookies that have already been saved can be deleted at any time. This can also be done automatically.

8. Newsletter

General information
You can subscribe to various newsletters on our website, which we use to inform you about our company's activities, current information about our services, special promotions and events. The content of the individual newsletter will be briefly described as part of the registration process. The legal basis for sending the respective newsletter is your consent pursuant to Art. 6 para. 1 p. 1 lit. a DSGVO in conjunction with. § Section 7 (2) No. 3 UWG or the legal permission according to Section 7 (3) UWG.

For the registration to our newsletters we use the so-called double-opt-in procedure. This means that after your registration, we will send you an e-mail to the e-mail address you provided, in which we ask you to confirm that you wish to receive the newsletter. If you do not confirm your registration, your information will be automatically deleted after 4 weeks.

Mandatory information for sending the newsletter is your e-mail address, as well as your first and last name. The provision of further data is voluntary. This data is used to address you personally. After your confirmation, we store your e-mail address for the purpose of sending the newsletter and until revoked. We also store your IP address current at the time of registration, the time of registration and confirmation for up to three years after registration (statute of limitations). The purpose of this procedure is to be able to prove your registration in case of doubt and, if necessary, to clarify any misuse of your personal data. The legal basis for logging the registration is our legitimate interest according to Art. 6 para. 1 p.1 lit. f DSGVO in proving a formerly given consent, see also Art. 7 para. 1 DSGVO.

You can revoke your consent to the sending of the newsletter at any time and unsubscribe from the newsletter. You can declare the revocation by clicking on the link provided in every newsletter email or by sending an email to ctngsdrknd.

Newsletter Tracking
We would like to point out that we evaluate your user behavior when sending the newsletter in order to determine whether and when the newsletter was opened. For this evaluation, the e-mails sent contain so-called web beacons or tracking pixels that are stored on our server and loaded when the newsletter is opened. Technical information such as browser type, time of opening and IP address are transmitted. For evaluations, we link the above data and the web beacons with your e-mail address and an individual ID.

With the data obtained in this way, we create a user profile in order to tailor the newsletter to your individual interests. In doing so, we record when you read our newsletters, which links you click on in them and infer your personal interests from this. We link this data to actions you have taken on our website. The legal basis for this data processing is your consent, Art. 6 para. 1 p.1 lit.a DSGVO.

You can revoke your consent at any time with effect for the future. The revocation in this case includes the entire newsletter, as a separate revocation of the tracking is unfortunately not technically possible. To do so, simply click the unsubscribe link provided in each email.

Moreover, such tracking is not possible if you have deactivated the display of images by default in your e-mail program. In this case, the newsletter will not be fully displayed to you and you may not be able to use all of its features. If you display the images manually, the tracking mentioned above will take place.

The information from the tracking is stored as long as you are subscribed to the newsletter. After unsubscribing, the data is anonymized and used for purely statistical purposes.

The data you provide for the purpose of receiving the newsletter will be stored by us until you unsubscribe from the newsletter and will be deleted after you unsubscribe from the newsletter.


9. Website analysis
For the purpose of analysing and optimising our websites we use various services, which are described below. For example, we can analyse how many users visit our site, which information is most in demand or how users find the offer. Among other things, we collect data about the website from which a person has accessed a website (so-called referrer), which sub-pages of the website were accessed or how often and for how long a sub-page was viewed. This helps us to design and improve our offers in a user-friendly way. The data collected is not used to personally identify individual users. Anonymous or at most pseudonymous data is collected. 9.1 Google Analytics
This website uses Google Analytics, a web analytics service operated by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. The use includes the Universal Analytics mode. This makes it possible to assign data, sessions and interactions across multiple devices to a pseudonymous user ID and thus analyse a user's activities across devices.
Google Analytics uses cookies that enable an analysis of your use of the website. The information generated by the cookie about how users use this website is usually transmitted to, and stored on, a Google server in the USA. However, in the event of the activation of IP anonymisation on this website, Google will truncate users' IP address beforehand in member states of the European Union or in other states party to the agreement on the European Economic Area. 9.2 Google Tag Manager

9.4 Conversion measurement with the visitor action pixel of Facebook
With your consent, we use the "visitor action pixel" of Facebook Inc, 1601 S. California Ave, Palo Alto, CA 94304, USA ("Facebook") within our Internet presence. It allows us to track the actions of users who have seen or clicked on a Facebook ad. This enables us to measure the effectiveness of Facebook ads for statistical and market research purposes. The data collected in this way is anonymous to us, i.e. we do not see the personal data of individual users. However, this data is stored and processed by Facebook, about which we inform you according to our level of knowledge. Facebook may link this information to your Facebook account and also use it for its own promotional purposes, in accordance with Facebook's Data Usage Policy https://www.facebook.com/about/privacy/. You can allow Facebook and its partners to serve ads on and off Facebook. A cookie may also be stored on your computer for these purposes.

11. Third-party content

This always presupposes that the providers of this content (hereinafter referred to as "third party providers") are aware of the IP address of the users. We have taken extensive technical and operational precautions to protect your data from accidental or intentional manipulation, loss, destruction or access by unauthorised persons. Our security procedures are regularly reviewed and adapted to technological progress.

 

14. Term of storage
Unless otherwise indicated, the personal data of the person concerned will be deleted or blocked as soon as the purpose of storage ceases to apply. Furthermore, data may be stored if this has been provided for by the European or national legislator in EU regulations, laws or other provisions to which the person responsible is subject. The data will also be blocked or deleted if a storage period prescribed by the aforementioned standards expires.

No automatic decision maker including profiling according to art. 22 GDPR exists.
